Terms of Service

1. Description of Service

DraftGraders is a community-driven platform for fantasy sports draft grading. Users submit their fantasy draft picks from NFL, NBA, MLB, and NHL leagues, receive ratings and feedback from the community, and can optionally purchase tokens to request professional grades from verified Pro Graders. The Service also includes leaderboards, user profiles, a draft strategy blog, and related features.

DraftGraders is an entertainment and community platform. All grades, ratings, and analysis provided through the Service are subjective opinions and should not be construed as professional advice or guarantees of fantasy league performance.

2. Eligibility

• You must be at least 13 years old (or 16 in the European Economic Area) to create an account and use the Service
• If you are between 13 and 18 (or the age of majority in your jurisdiction), you represent that you have your parent or guardian's consent to use the Service
• You must provide accurate and complete information when creating your account
• By using the Service, you represent that you meet these eligibility requirements

3. Account Registration & Security

• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account
• You must use a valid email address that you control
• You may not use offensive, misleading, or impersonating display names
• One account per person — creating duplicate or alternate accounts to manipulate ratings, circumvent bans, or game the system is prohibited and may result in permanent suspension of all associated accounts
• You must notify us immediately at support@draftgraders.com if you suspect unauthorized access to your account
• We reserve the right to reclaim display names that are inactive, infringing, or misleading

4. Tokens & Purchases

DraftGraders uses a virtual token economy to facilitate pro grading services:

• Nature of tokens: Tokens are a virtual currency used exclusively within DraftGraders to request pro grades, add rush priority, and tip graders. Tokens have no cash value outside the platform and cannot be exchanged for real currency by users.
• Purchasing tokens: Token packs are available for purchase via Stripe. All prices are displayed in USD. You agree to pay all charges at the prices in effect when you make your purchase.
• Token pricing: We reserve the right to modify token pack pricing and sizes at any time. Price changes will not affect tokens already purchased.
• Expiration: Unused tokens expire 12 months after the date of purchase. Expired tokens cannot be recovered or refunded.
• No resale: Tokens may not be sold, traded, transferred, or gifted to other users.
• Refunds: Token purchases are subject to our Refund Policy. Generally, token purchases are non-refundable once tokens have been used.

5. Pro Graders

Our Pro Grader program connects users with verified fantasy sports analysts:

• Status: Pro Grader status is granted at our sole discretion based on demonstrated knowledge, grading quality, and platform reputation. It can be revoked at any time for violations of these Terms or quality standards.
• Independence: Pro Graders are independent contributors, not employees, agents, or representatives of DraftGraders. We do not guarantee the accuracy, completeness, or quality of any individual pro grade.
• Compensation: Pro Graders earn tokens for completed grade requests, which may be redeemable under our Pro Grader payout terms. DraftGraders retains a service fee on each transaction.
• Opinions, not advice: Pro grades represent the subjective opinion of the grader. They are not financial advice, gambling advice, or guarantees of fantasy sports performance.
• Timeliness: Pro Graders are expected to fulfill grade requests in a reasonable timeframe. Rush requests receive prioritized handling.

6. User Content

You are responsible for all content you post, upload, or share through the Service ("User Content"):

• Ownership: You retain ownership of your User Content (draft submissions, comments, ratings, and reviews)
• License grant: By posting User Content, you grant DraftGraders a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, modify, and distribute your content in connection with operating and promoting the Service
• Public nature: User Content is public by default. Your display name, drafts, ratings, and comments are visible to all visitors of the platform, including search engines. Do not post content you wish to keep private.
• Accuracy: You represent that your User Content is accurate and does not infringe any third party's rights
• Removal: We reserve the right to remove any User Content at our discretion, with or without notice, for any reason including violations of these Terms

7. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Manipulating ratings, grades, leaderboard rankings, or any other metric through fake accounts, coordinated voting, or automated tools
• Using bots, scrapers, crawlers, or automated tools to access or interact with the Service beyond what is available through our standard interface
• Attempting to exploit, reverse-engineer, or circumvent the token system, payment processing, or security measures
• Posting content that is abusive, harassing, threatening, hateful, discriminatory, defamatory, obscene, or illegal
• Harassing, bullying, or intimidating other users or Pro Graders
• Impersonating any person or entity, or misrepresenting your affiliation with any person or entity
• Spamming, phishing, or distributing malware through the Service
• Circumventing rate limits, security measures, or access restrictions
• Using the Service for any purpose that is illegal or prohibited by these Terms
• Interfering with or disrupting the integrity or performance of the Service

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by DraftGraders and are protected by copyright, trademark, and other intellectual property laws. The DraftGraders name, logo, and brand elements are trademarks of DraftGraders. You may not use them without our prior written consent.

DraftGraders is not affiliated with, endorsed by, or sponsored by the NFL, NBA, MLB, NHL, or any fantasy sports platform (Sleeper, ESPN, Yahoo, etc.). All team names, player names, logos, and related trademarks are the property of their respective owners and are used for informational and community discussion purposes only.

9. Draft Import & Third-Party Platforms

DraftGraders allows you to import draft data from third-party fantasy platforms (Sleeper, ESPN, Yahoo, and others). By using these import features, you acknowledge that:

• You are responsible for ensuring you have the right to share your draft data from these platforms
• Imported data accuracy depends on the third-party platform's API and may not always be perfectly accurate
• We are not responsible for any issues arising from third-party platform API changes, outages, or data discrepancies

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure; that defects will be corrected; or that the Service or the servers that make it available are free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or timeliness of any grades, ratings, or analysis provided through the Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DRAFTGRADERS, ITS OPERATORS, AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, TOKENS, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service, including Pro Graders
• Any content obtained from the Service, including grades and ratings
• Unauthorized access, use, or alteration of your transmissions or content
• Any fantasy league outcomes or decisions based on information from the Service

Our total cumulative liability to you for all claims arising from or relating to the Service shall not exceed the greater of (a) the amount you have paid us in the twelve (12) months preceding the claim or (b) fifty US dollars ($50.00).

12. Indemnification

You agree to indemnify, defend, and hold harmless DraftGraders and its operators, affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your User Content, or your use of the Service.

13. Termination

• We may suspend or terminate your account at any time, with or without cause or notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users or the Service, or is otherwise objectionable
• You may request deletion of your account at any time by contacting support@draftgraders.com
• Upon termination, your right to use the Service ceases immediately. Any unused tokens are forfeited and non-refundable upon termination for cause.
• Provisions that by their nature should survive termination (including ownership, warranty disclaimers, indemnification, and limitations of liability) will survive

14. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable rules, except that either party may seek injunctive relief in court for intellectual property or security violations.

15. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and may post a prominent notice on the Service. Your continued use of DraftGraders after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and DraftGraders regarding your use of the Service.
